1. General Provisions

These terms and conditions of sale and purchase (hereinafter referred to as the “Terms”) constitute a legally binding document for the Parties, outlining the rights, obligations, and responsibilities of the Buyer and the Seller when the Buyer purchases goods from the online store.

The Seller reserves the right to modify, correct, or supplement the Terms at any time, in accordance with the requirements set by applicable laws. The Buyer will be informed via the online store’s website. The Terms in effect at the time the order is placed apply to the Buyer’s purchase in the online store.

The right to purchase from the online store is granted to:

  • legally capable natural persons, i.e., individuals who have reached the age of majority and whose legal capacity has not been restricted by a court;
  • minors aged 14 to 18, only with the consent of their parents or guardians, except in cases where they independently manage their own income;
  • legal entities;
  • authorized representatives of all the above-mentioned persons.

By confirming the Terms, the Seller also guarantees that the Buyer has the right to purchase goods in the online store, e.g., children’s lighting.

The contract between the Buyer and the Seller is considered concluded from the moment the Buyer, in the online store, creates a shopping cart, provides the delivery address, selects the payment method, and, having read the Seller’s Terms, clicks the “Confirm Order” button.

Each contract concluded between the Buyer and the Seller is stored in the online store.

2. Personal Data Protection

The Buyer can order goods from the online store by:

  • registering on the online store by entering the required information during registration;
  • without registering on the online store.

When placing an order, the Buyer must provide, in the relevant information fields provided by the Seller, the personal data necessary for proper order fulfillment: first and last name, delivery address, phone number, and email address.

By consenting to the processing of the Buyer’s personal data for the purpose of selling goods and services in the Seller’s online store, the Buyer also agrees that informational messages necessary to fulfill the order may be sent to the email address and phone number provided by the Buyer.

3. Buyer’s Rights and Obligations

The Buyer has the right to purchase goods in the online store in accordance with these Terms and the procedures set out in other sections of the online store’s information.

The Buyer has the right to withdraw from the sale and purchase contract with the online store by notifying the Seller in writing (via email, indicating the item to be returned and its order number) no later than 7 (seven) working days from the date of delivery, except in cases where withdrawal is not allowed under the laws of the Republic of Lithuania (e.g., when the contract is concluded for the sale of hygiene products – such as bedding items; see information on the website of VšĮ “Vartotojų centras” http://www.vartotojucentras.lt/istatymas.php?id=1038, “Special rules for returning and exchanging non-food goods”).

The Buyer undertakes to accept the ordered goods and pay the agreed price for them.

If the information provided by the Buyer in the registration form changes, the Buyer must update it without delay.

The Buyer undertakes not to share their login credentials with third parties. If the Buyer loses their login information, they must immediately notify the Seller using the contact methods provided in the “Contact” section.

By using the online store, the Buyer agrees to these Terms of Sale and Purchase and undertakes to comply with them and not violate the laws of the Republic of Lithuania.

4. Seller’s Rights and Obligations

The Seller undertakes to provide all conditions necessary for the Buyer to properly use the services offered by the online store.

If the Buyer attempts to compromise the stability or security of the Seller’s online store or breaches their obligations, the Seller has the right to immediately and without warning restrict or suspend the Buyer’s access to the online store, or, in exceptional cases, cancel the Buyer’s registration.

The Seller undertakes to respect the Buyer’s privacy rights regarding the personal information provided by the Buyer in the online store’s registration form.

The Seller undertakes to deliver the Buyer’s ordered goods to the address specified by the Buyer.

5. Ordering Goods, Prices, Payment Procedures, and Terms

The Buyer can make purchases in the online store 24 hours a day, 7 days a week.

The contract becomes effective from the moment the Buyer clicks the “Confirm Order” button, and the Seller confirms the order by sending a confirmation email to the Buyer’s specified email address.

The prices of goods in the online store and in the generated order are indicated in euros, [including VAT].

The buyer undertakes to pay for the goods immediately. Only upon receipt of payment for the goods will the shipment of the goods begin to be prepared, and the delivery period will start to be calculated.

After receiving the order, the seller confirms the buyer’s order acceptance and sets the delivery time for the goods. The delivery period is determined separately for each goods order.

6. Quality of Goods, Warranty

The details of each product sold in the online store are generally provided in the product description of each item.

The seller is not responsible if the products in the online store may not match the actual size, shape, or color of the goods due to the characteristics of the buyer’s display device.

For certain types of goods, the seller provides a quality warranty valid for a specific period, the exact duration and other conditions of which are indicated in the descriptions of such products.

If the seller does not provide a quality warranty for certain types of goods, the warranty specified by the relevant legislation shall apply.

7. Buyer’s and Seller’s Responsibility

The buyer is fully responsible for the accuracy of the personal data provided. If the buyer does not provide accurate personal data in the registration form, the seller is not responsible for any consequences arising from this and has the right to claim compensation from the buyer for any direct losses incurred.

The buyer is responsible for all actions performed while using this online store.

A registered buyer is responsible for not sharing their login credentials with third parties. If a third party uses the online store’s services by logging in with the buyer’s credentials, the seller will consider that person as the buyer.

The seller is released from any liability in cases where losses arise because the buyer, disregarding the seller’s recommendations and the buyer’s obligations, did not familiarize themselves with these Terms, even though the opportunity to do so was provided.

If the seller’s online store contains links to the websites of other companies, institutions, organizations, or individuals, the seller is not responsible for the information or activities on those sites, does not monitor or control them, and does not represent those companies or individuals.

In the event of damage, the party at fault shall compensate the other party for direct losses.

8. Marketing and Information

The seller may initiate various promotions in the e-shop at their own discretion.

The seller has the right to unilaterally change or cancel the terms of promotions without separate notice. Any change or cancellation of promotional terms and procedures is only valid moving forward, i.e., from the moment they are implemented.

The seller sends all notifications using the contact details provided in the Buyer's registration form.

The Buyer sends all notifications and inquiries to the telephone numbers and email addresses specified in the "Contacts" section of the Seller's e-shop.

The Seller shall not be held liable if the Buyer does not receive sent informational or confirming notifications due to disturbances in internet connection or email service provider networks.

9. Final provisions

These Rules for the purchase and sale of goods have been drawn up in accordance with the laws and legal acts of the Republic of Lithuania.

All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
